Your Consumer Rights

As a consumer, you are entitled to rights under the Australian Consumer Law (ACL) regarding our products that cannot be excluded. Nothing in these terms is intended to limit or exclude those rights.

Our Liability to You

To the extent permitted by law (including the ACL), our liability is limited or excluded under these terms. Here’s what that means:

  • All implied terms and warranties are excluded.
  • We are not responsible for indirect or consequential losses.
  • Once your order has been delivered to you or an ATL (Authority to Leave) address, we are not liable for loss, theft, or damage to the products.
  • We are not responsible for losses caused by unauthorized or fraudulent use of your credit/debit card, unless it resulted from our actions or omissions.
  • If we are found liable for any loss you suffer:
    • Our liability will be reduced or limited to the extent that you contributed to the loss.
    • Our liability will not exceed the total value of the products you purchased that relate to the loss, except where our actions or omissions caused or contributed to it.

We may update these terms periodically. Any changes will apply to orders placed after the updated terms are published on our website. The terms in effect at the time of your order will apply to that purchase.

You cannot modify these terms without our written approval. If we make changes to these terms, they will take effect once published on our website and will not affect orders already placed. We recommend reviewing these terms regularly and contacting us if you have any questions.

Your Order

Once your order is placed and payment is processed, we’ll send you an email confirming receipt of your order request. However, this confirmation does not guarantee product availability. Your order becomes a binding agreement when we dispatch the product(s) and email you a dispatch confirmation.

We reserve the right to accept or cancel orders at any time for a variety of reasons, including:

  • Breach of these or other applicable terms or laws.
  • Product unavailability (e.g., out of stock).
  • Errors in pricing, images, or product descriptions.
  • Mistakes in your order details.
  • Payment or address issues.
  • Fraud prevention or excessive returns.
  • Shipping constraints, restrictions, or product recalls.
  • Technical issues or force majeure events.
  • Failure to meet minimum order requirements (if applicable).

If your order is cancelled, we will notify you via email. You may choose to receive either a full refund or store credit.

Prices, Payment, and GST

All prices displayed on the Dudley & Co website are in Australian dollars and include GST. Payments are also processed in Australian dollars. We offer various payment methods, including credit cards, PayPal, and other options listed during checkout.

Shipping Promotions

Occasionally, we offer shipping discounts, such as free shipping, flat rates, or capped pricing on certain products. These promotions are often limited to specific items and locations. Check the Promotional Terms & Conditions for more details.

Payment Security

We use a third-party payment processor (PayPal Braintree) to handle payments securely. This processor collects the necessary details for transactions, such as card numbers, CVV codes, and expiration dates, and may process your information in line with its own privacy policy. Dudley & Co does not permanently store or access your full payment information. In cases where bank details are collected for refunds, they are handled according to our privacy policy.

While we take measures to protect against fraudulent activity, we cannot guarantee prevention of unauthorized use of payment information by third parties. Fraud checks may require proof of identity or validation of payment details. Orders flagged for review will be held until confirmed legitimate. Dudley & Co reserves the right to cancel any order deemed suspicious.

Delivery Information

Delivery Fees

Delivery costs and times vary based on the size, weight, origin, and destination of your order. Fees are calculated and displayed during checkout before payment. Changes to delivery details after an order is placed may result in additional charges.

Dispatch Times

Products usually ship within 1–3 business days after payment is processed unless otherwise noted. For custom or made-to-order items, dispatch times may be longer. Delays caused by unforeseen circumstances or fraud checks will be communicated promptly.

Delivery Methods and Locations

Dudley & Co partners with trusted third-party providers to ensure nationwide delivery. Most orders are delivered to the ground floor of your designated address. Delivery to PO boxes or parcel lockers is unavailable due to the size of most items.

We may refuse delivery to certain locations deemed high-risk or inaccessible. In such cases, you can arrange for your own courier. Title and risk transfer to you when the order is handed to your courier.

Delivery Options

  • Standard Delivery: Suitable for most items, this method uses national carriers (e.g., Australia Post, Allied Express). Delivery occurs Monday to Friday and typically excludes weekends or specific time requests.
  • Specialist Delivery: For oversized or fragile items, our two-person delivery service ensures careful handling and placement. Additional stairs or lift access may require prior arrangements.

Missed Deliveries

If you’re unavailable during delivery, a notification will be left, and redelivery arrangements can be made with the provider. Alternatively, authorizing an "Authority to Leave" (ATL) at a safe location can help avoid missed deliveries.

Delivery Failure

Ensure your delivery details are accurate when placing an order. If incorrect details lead to a failed delivery, additional charges may apply. Orders undelivered after two attempts or 21 days may be canceled, with a refund issued minus delivery and handling fees.

Risk and Ownership

Ownership and responsibility for the products transfer to you upon delivery to the specified address or ATL location.

Product Information

We strive for accuracy in product descriptions, but occasional errors may occur. Handmade or natural products may vary slightly in appearance from images, and colors may differ due to screen variations. These are not considered faults.

Dudley & Co reserves the right to modify or remove products and website content. Changes will apply to future orders but not those already placed.

We utilize advanced technologies, including artificial intelligence, to enhance the customer experience. While every effort is made to ensure accuracy, occasional discrepancies may arise.

Our website is continually optimized, and you may experience personalized features or testing variations that differ from those of other customers.

Returns

Change of Mind Returns
At Dudley & Co, we want you to be completely satisfied with your purchase. If you change your mind, you can return the product to us within 30 days of receiving it, and we’ll provide you with a store credit. Some exceptions apply, as indicated on the product page. Please note that change-of-mind returns differ from returns related to faulty products under Australian Consumer Law (see "Your Rights under the Australian Consumer Law" below).

For change-of-mind returns, customers are responsible for covering all shipping costs, including the initial delivery and return shipping fees, regardless of any shipping promotions applied to the order.

To initiate a return, log in to your account, navigate to the "My Account" section, and select "Get Help." Alternatively, contact our Customer Care team with your name and order details, and we’ll assist you with the return process.

Returned products must be in their original, unused condition, securely packaged in the original packaging. This includes no signs of use, assembly, washing, or damage.

The following products are not eligible for change-of-mind returns:

  • Items labeled as "made to order"
  • Mattresses and bedding, including quilts, pillows, mattress toppers, protectors, and underlays
  • Clearance items
  • Personalized products
  • Seasonal merchandise
  • Gift Cards
  • Products intended for commercial or non-domestic use
  • Items assembled or installed by Dudley & Co or our contractors upon delivery

Upon receiving and inspecting the returned item (usually within five business days for NSW), we will issue a store credit equal to the purchase price minus shipping fees. Store credits are valid for one year from the date of issue.

Returns cannot be delivered in person to our depots, offices, or warehouse facilities.

Purchase Protection
For added convenience, Dudley & Co offers optional Purchase Protection for a small fee at checkout, providing additional flexibility for change-of-mind returns. Please note that the Purchase Protection fee is non-refundable.

Purchase Protection Benefits:

  • Refund Flexibility: With Purchase Protection, you may choose a refund to your original payment method (100% of the item value) or store credit (110% of the item value). Shipping fees are not refundable.
  • Extended Return Period: Returns are accepted within 100 days of receipt under this plan. Without it, the standard return period is 30 days.
  • Rapid Reorder: For replacements, we’ll process a new order before receiving the returned item. If backordering is necessary, you’ll have the option to accept or cancel the order.

We reserve the right to refuse claims under the Purchase Protection policy if terms and conditions are not met.

 

Other Policies
Dudley & Co reserves the right to cease business with any customer at any time. We may block access to our website, restrict contact with our offices, or take other reasonable actions if a customer engages in conduct that we consider to be unprofessional, inappropriate, bullying, or abusive.

Our Privacy Policy, available on our website, outlines our practices for collecting, using, and disclosing information. It forms part of these Terms. By using our website, you agree to the processing of your information as described in our Privacy Policy and confirm that all data you provide is accurate.

To make a purchase on our website, you must provide personal information, including your full name, billing and shipping addresses, mobile phone number, and email address. You’ll also need to provide valid payment details to complete transactions. By entering payment information, you confirm that you are the authorized holder of the payment method and that the details provided are accurate and valid.


Force Majeure
Dudley & Co is not liable for delays, suspensions, or failures resulting from circumstances beyond our reasonable control. This includes but is not limited to:

  • Acts of God
  • Government actions or restrictions
  • Shipping, postal, or transport strikes
  • Postal theft, failures, or accidents
  • Labour disputes, lockouts, or other industrial difficulties
  • War, national emergencies, or acts of terrorism
  • Epidemics, pandemics, or quarantine requirements
  • Fires, explosions, floods, or natural disasters
  • Actions or failures by third parties (including delivery partners)
  • Shortages of materials, equipment, or services
  • Interruptions to internet services or social media platforms
  • Viruses, hardware/software failures, or communication network disruptions

Applicable Law
These Terms are governed by the laws of New South Wales, Australia, and are subject to the non-exclusive jurisdiction of its courts. Our website is intended for use by individuals who are legally capable of forming binding contracts under applicable law.


Relationship
These Terms do not establish any agency, partnership, joint venture, employer-employee, or franchisor-franchisee relationship between you and Dudley & Co.


Severability
If any provision within these Terms is determined to be invalid or unenforceable by a court, the remaining provisions will remain in full effect.
